President Herzog Expunges Criminal Record of Ex-Soldier Elor Azaria

President Isaac Herzog announced Saturday evening that he has decided to expunge the criminal record of Elor Azaria, the former IDF soldier convicted of shooting a neutralized Palestinian assailant. The President's office stated that key considerations for the pardon included the passage of time since the shooting incident, Azaria's having served his sentence, and enabling him to "start a new chapter in his life." The office also noted that the President weighed the complex medical circumstances the Azaria family faced over the years since the incident, emphasizing that the decision does not undermine the legal proceedings.

In contrast, the Israel Defense Forces (IDF) expressed criticism of the decision, revealing they had recommended the Defense Minister not adopt it. The IDF stated that "Azaria refrained from expressing remorse or taking responsibility for his actions." Earlier in July, Defense Minister Israel Katz had requested the expungement of Azaria's criminal record. Katz had written to the President seeking a pardon for Azaria, highlighting that over a decade had passed since the 2014 incident in Hebron where Azaria shot the wounded assailant. Katz also pointed out that Azaria completed his full prison sentence in 2018 and that the current request was solely to shorten the period for expunging the record, as the statutory statute of limitations had already passed.

Katz welcomed the President's decision, calling it "a correct, humane, and worthy decision that expresses the spirit of forgiveness and the possibility of starting a new page," especially on the eve of Yom Kippur. Azaria himself had previously requested a commutation of his sentence, stating he wanted to "return to life." Azaria was released to house arrest pending a decision on his appeal.
