President Herzog Shortens Criminal Record Erasure Period for Elor Azaria

President Isaac Herzog has decided to shorten the period during which Elor Azaria's criminal record will remain active, a move that will ease his reintegration into civilian life. The decision, signed on September 19, comes nearly a decade after the controversial 2016 incident in Hebron where Azaria, an IDF soldier, fatally shot a Palestinian assailant who had already been subdued.

The President's office stated that the decision was made after considering all circumstances of the case, including the significant time elapsed since the events, the sentence Azaria has already served, and changes in his personal and family life. The decision was also influenced by the timing, during the Jewish High Holy Days, a period associated with mercy and forgiveness, aiming to remove remaining obstacles for Azaria, particularly in employment.

This decision does not overturn Azaria's conviction for manslaughter or erase the fact of his conviction. Instead, it utilizes the President's authority to shorten the erasure period for a criminal record after legal proceedings have concluded. This means the duration for which the record impacts Azaria is reduced, potentially aiding him in areas requiring disclosure of past criminal history, especially for employment.

The case, which began in March 2016, sparked intense public debate in Israel regarding rules of engagement, IDF values, and the relationship between the military, political echelon, and the public. Azaria was convicted in January 2017 and sentenced to 18 months in prison, later reduced to 14 months. He was released in May 2018.

While Defense Minister Israel Katz supported Azaria's request, citing the time passed and Azaria's efforts to rebuild his life, the IDF's Chief of Staff and Head of Manpower opposed it. They argued Azaria had not shown remorse and that no exceptional circumstances justified altering the statutory erasure period. This is not the first time Azaria sought presidential clemency; a previous request was denied in 2017.
