These Terms of Service govern your access to and use of baba News. baba News is an independent aggregator and index of publicly available journalism: for each story we provide an English machine translation, an AI-generated summary, key points, and cross-source comparison, always with attribution and a link to the original at its source. Please read these terms carefully — by accessing or using the site you agree to be bound by them.

1. Acceptance of these terms and eligibility

These Terms of Service (the “Terms”) form a binding agreement between you and the operators of baba News (“baba News,” “we,” “us,” or “our”), the team behind the baba translation product. They govern your access to and use of the baba News website, its pages, feeds, and all related content and services (together, the “Service”). By accessing, browsing, or otherwise using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by every policy incorporated into them by reference, including our Privacy Policy, our AI and translation policy, and our editorial standards.

If you do not agree with any part of these Terms, you must not access or use the Service. By using the Service you represent and warrant that you are at least the age of majority in your jurisdiction, or that you are at least eighteen (18) years old, and that you have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization. Your continued use of the Service following any change to these Terms constitutes acceptance of the revised Terms.

2. What baba News is — and what it is not

baba News is an independent aggregator, index, and discovery service. We continuously monitor a large number of publicly available Israeli and Hebrew-, Arabic-, Russian-, and English-language news sources. For each item we surface, we generate an English machine translation, a brief AI-generated summary, a list of key points, the people, organizations, and places involved, and — where several outlets cover the same event — a cross-source comparison showing how coverage differs across the political spectrum. Every item is presented with clear attribution to the originating outlet and a prominent link directing readers to the original article at the source.

baba News is not the original publisher of the underlying journalism, is not a newsroom, and conducts no original reporting. We do not hold ourselves out as the author or rights-holder of the source articles. We are not affiliated with, sponsored by, endorsed by, partnered with, or connected to any of the outlets we index, nor with any government, political party, or advocacy organization, and nothing on the Service should be read as suggesting otherwise. Our function is to help English-speaking readers find, understand, and navigate to journalism that others have produced — in the manner of a news index or aggregator — and then to send them onward to read that journalism at its original home. References to third-party outlets, their names, and their marks are used solely for identification, attribution, and factual reference, on a nominative basis, and do not imply any association or endorsement.

3. Intellectual property in source material

baba News fully respects the intellectual property rights of the newsrooms and journalists whose work it indexes. All right, title, and interest in and to the original articles, headlines, photographs, video, underlying reporting, and other source material — including all copyright — remain exclusively with the respective newsrooms, publishers, and rights-holders. baba News claims no ownership whatsoever of that source content, asserts no proprietary interest in it, and does not purport to license it to you. Nothing in the Service transfers any ownership of source material to baba News or to you.

baba News’s use of source material is deliberately limited to what is necessary to function as a news index and reference service: identifying the existence of a story, reporting its factual substance, quoting brief excerpts, providing attribution, and linking out to the original. We believe in good faith that this use is protected. In the United States, we rely on the doctrine of fair use codified at 17 U.S.C. § 107 — our use is transformative (translation, summarization, cross-source analysis, and indexing for a different purpose and audience), uses only the amount of any work reasonably necessary, and is designed to drive readers to the originals rather than to substitute for them, so as not to usurp the market for the original works. In Israel, we rely on the permitted uses set out in the Israel Copyright Act, 5768-2007, including the fair use provision at section 19 and the permitted uses for news reporting and for quotation, each as interpreted by the Israeli courts. As a foundational matter, facts, ideas, and the news of the day are not themselves protected by copyright in either jurisdiction; copyright protects a particular expression, not the underlying information, and baba News conveys information while directing readers to the protected expression at its source.

These positions reflect our good-faith assessment and our intent to operate lawfully and respectfully toward rights-holders. They are not a guarantee of any legal outcome, and nothing here waives or limits any rights-holder’s ability to contact us under Section 5 below, to which we respond promptly.

4. baba News’s own content and marks

While the source articles belong to their publishers, the material that baba News itself creates — the English translations, the AI-generated summaries, the extracted key points, the entity lists, the clustering of related coverage, the cross-source bias and coverage analysis, the lean labels, the page design, the compilation and arrangement of the index, and the accompanying text — is the intellectual property of baba News or its licensors, and is protected by copyright, database, and other laws. The “baba” and “baba News” names, logos, and associated marks are owned by us.

Subject to your continued compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view our content for your own personal, non-commercial use, and to share links to stories. You may not, without our prior written permission: scrape, crawl, harvest, index, or bulk-download the Service or its content; copy, reproduce, republish, distribute, sell, or commercially exploit our translations, summaries, or analysis; create a derivative, competing, or substitute product or dataset from them; use them to train, fine-tune, or develop any machine-learning model; remove or obscure any attribution, link, or proprietary notice; or use our name, logos, or marks except as strictly necessary for factual reference. All rights not expressly granted are reserved.

5. Copyright complaints, notice and takedown (DMCA and Israel)

We take copyright seriously and maintain a clear notice-and-takedown process. If you are a rights-holder (or an agent authorized to act for one) and you believe in good faith that material accessible on the Service infringes your copyright, please send a written notice to news@itsbaba.com. To enable us to act, your notice should include, consistent with the requirements of the U.S. Digital Millennium Copyright Act (the “DMCA,” 17 U.S.C. § 512(c)(3)) and applicable Israeli practice:

  • Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
  • Identification of the material claimed to be infringing and the specific baba News URL(s) where it appears, with enough detail for us to locate it.
  • Your contact information — name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
  • Your physical or electronic signature.

Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the material claimed to be infringing. We operate as a neutral intermediary and intend to qualify for the protections available to service providers under the DMCA safe harbor (17 U.S.C. § 512) in the United States and under Israel’s intermediary and notice framework (including the notice-and-takedown principles recognized under Israeli copyright law and the standards developed in Israeli case law). We do not undertake to monitor for infringement but respond to valid notices.

Repeat infringers. Where a source or party is the subject of repeated, valid infringement notices, we will take appropriate action, which may include ceasing to index or permanently excluding the material or source in question.

Counter-notice. If you believe material was removed or disabled in error or as a result of misidentification, you may submit a counter-notice to news@itsbaba.com that identifies the material and its former location, includes your name, address, and telephone number, includes a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, includes (where applicable under the DMCA) your consent to jurisdiction as provided by 17 U.S.C. § 512(g), and bears your physical or electronic signature. Please note that knowingly making a material misrepresentation in a takedown notice or counter-notice may expose you to liability under applicable law.

6. AI and machine-translation disclaimer

The English translations, summaries, key points, entity extractions, clustering, lean labels, and cross-source comparisons on baba News are produced by automated and artificial-intelligence systems. They are inherently imperfect. They may be — and at times will be — inaccurate, incomplete, out of date, misleading, or simply wrong; they may contain mistranslations, omissions, mischaracterizations, or fabricated detail; and they may not reflect the meaning, nuance, tone, or factual content of the original article. AI-generated output on baba News is not a substitute for the original article and must not be treated as such. It is a convenience and a starting point for discovery, not an authoritative record. For anything that matters — and certainly before relying on, republishing, quoting, or making any decision based on a story — you must read the original at its source, which we link for exactly this reason. We make no representation or warranty that any translation, summary, or analysis is accurate, complete, current, or fit for any purpose, and, to the fullest extent permitted by law, we disclaim all liability for any reliance on AI-generated output.

7. No warranty — the Service is provided “as is”

The Service and all of its content are provided “as is” and “as available,” with all faults and without warranty of any kind. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including any implied warranties or conditions of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components, that defects will be corrected, or that any content (including any translation, summary, or analysis) is accurate, complete, or reliable. Any material obtained through the Service is accessed at your own discretion and risk. No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated in these Terms.

8. Limitation of liability

To the fullest extent permitted by applicable law, in no event will baba News, its operators, owners, the baba team, or any of their respective affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, including without limitation damages for loss of profits, revenue, goodwill, data, business opportunity, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Service or any content on it (including any reliance on AI-generated translations, summaries, or analysis), whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid us, if any, to use the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100). Because the Service is provided free of charge for personal use, you acknowledge that this allocation of risk is a fundamental basis of the bargain between us. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions and limitations may not apply to you; in such jurisdictions our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless baba News, its operators, owners, the baba team, and their respective affiliates, officers, employees, agents, suppliers, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms or of any applicable law; (c) your violation or infringement of any third-party right, including any intellectual property or privacy right; or (d) any content you submit, transmit, or make available through the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

10. Third-party sites and content

Every story on baba News links out to an external news site, and the Service may contain other links to or content from third parties. Those sites and that content are not under our control. We provide links and references for convenience and attribution only, and their inclusion does not imply our endorsement of, or responsibility for, the linked site or its operator. We are not responsiblefor the availability, accuracy, content, products, services, privacy practices, or any other aspect of any third-party site. When you follow a link away from baba News you leave the Service and are subject to the destination’s own terms and privacy policy, which you should review. Your dealings with any third party are solely between you and that third party. Our sources page lists the outlets we index and link to.

11. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not attempt to or permit any third party to: use the Service in violation of any applicable law or regulation; scrape, crawl, spider, harvest, or use any automated means to access, extract, or copy the Service or its content except as expressly permitted; reproduce, redistribute, or build a competing or substitute product or dataset from our translations, summaries, or analysis; use the content to train or develop any machine-learning model; interfere with, disrupt, overload, or impair the Service or the networks or systems connected to it, including by denial-of-service activity or by sending excessive requests; probe, scan, or test the vulnerability of the Service or breach or circumvent any security, authentication, or rate-limiting measure; misrepresent baba News’s AI-generated content as original reporting or as the work of, or as endorsed by, any outlet it covers; impersonate any person or entity or misstate your affiliation; or use the Service to infringe, misappropriate, or violate the intellectual property, privacy, or other rights of any person. We may investigate and take appropriate action, including restricting or terminating access, for any actual or suspected violation.

12. Governing law, jurisdiction, and dispute resolution

These Terms and any dispute or claim arising out of or relating to them or to the Service (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-laws rules. You and baba News agree that the competent courts of Tel Aviv-Jaffa, Israel, shall have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts and waive any objection to that forum.

Nothing in this section limits the operation of United States federal copyright law: copyright complaints and counter-notices concerning material accessible from the United States are handled under the DMCA (17 U.S.C. § 512) as described in Section 5, and U.S. federal copyright law applies to those takedown procedures. To the extent any mandatory consumer-protection law of your country of residence grants you rights that cannot be waived by contract, nothing in these Terms is intended to override those rights.

Informal resolution first. Before commencing any formal proceeding, you agree to first contact us at news@itsbaba.com and to attempt, in good faith, to resolve the dispute informally. Most concerns — including copyright and takedown matters — can be resolved quickly this way, and we ask that you give us a reasonable opportunity (at least thirty (30) days from your written notice) to address the issue before escalating.

13. Changes to these terms

We may modify these Terms from time to time as the Service evolves or as legal requirements change. When we do, we will update the “last updated” date shown above. Material changes take effect when posted, and your continued access to or use of the Service after the changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service. We encourage you to review this page periodically. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that or any other right or provision. These Terms are the entire agreement between you and baba News regarding the Service and supersede any prior agreements on that subject.
