President Herzog Pardons Elor Azaria, Overruling Military Chief's Objection

President Isaac Herzog announced Saturday that he has decided to expunge the criminal record of Elor Azaria, who was convicted a decade ago for the fatal shooting of a neutralized Palestinian assailant. This decision was made despite the opposition of IDF Chief of Staff Lt. Gen. Herzi Halevi, who had previously advised against it.

The President's Residence stated that Herzog decided to grant Azaria's request to erase the remainder of his criminal record, allowing him to move forward with his life. The statement cited that after years of Azaria bearing the consequences of his actions, the President believes the circumstances, the passage of time, and the remorse Azaria has expressed justify allowing him a fresh start. The decision was also framed within the spirit of the High Holy Days, emphasizing reconciliation and moving forward.

Previously, the IDF's legal advisor and head of the Manpower Directorate had opposed the request, deeming it an unusual step as Azaria had not demonstrated sufficient grounds or expressed remorse. However, the President's Residence now claims Azaria expressed sorrow in a letter and that circumstances have changed. The President's decision also considered Azaria's difficult personal and family circumstances over the years, his desire to overcome employment barriers, and his commitment to IDF values.

President Herzog emphasized that his decision does not challenge the legal proceedings or re-examine the case, affirming the importance of the military justice system and the principle of "purity of arms." The President's decision followed a recommendation from Defense Minister Israel Katz, who also expressed support for the move, calling it a humane and appropriate decision in the spirit of forgiveness. Katz linked the pardon to the broader context of Israeli security, noting the release of hundreds of terrorists in prisoner exchanges and the need to allow Azaria to reintegrate into society after serving his sentence.

National Security Minister Itamar Ben-Gvir also reacted positively, calling for Azaria to be allowed to return to IDF service and urging the President to also pardon Prime Minister Benjamin Netanyahu, whose legal cases he described as baseless.
