President Herzog Expunges Criminal Record of Elor Azaria

President Isaac Herzog has signed an order to shorten the period of expungement from the criminal record of Elor Azaria, a former IDF soldier convicted of manslaughter. The decision, made on the eve of Yom Kippur, allows Azaria to move forward in life without a criminal record.

President Herzog's decision followed a comprehensive review of the case's circumstances and considerations, ultimately granting Azaria's request, which was supported by Defense Minister Israel Katz. The President cited the significant time elapsed since the incident, Azaria's completion of his sentence, and the statute of limitations having passed as key factors. He also considered Azaria's changed personal and family circumstances and his desire to overcome employment barriers.

Azaria, now a father of two, expressed respect for IDF values and regret for the consequences of the incident, stating that in hindsight, the shooting was an operational error he would not repeat. The President also weighed the complex medical issues faced by Azaria's family over the years and the transformation in Azaria's life.

President Herzog emphasized that his decision does not undermine the legal proceedings or the military justice system's role in upholding the law and IDF values, particularly purity of arms. He clarified that the clemency institution is one of grace, not an appellate court.

Elor Azaria was convicted in 2017 for shooting and killing a wounded Palestinian assailant in Hebron in 2016. He was sentenced to 18 months in prison, later reduced by then-Chief of Staff Gadi Eisenkot, and served nine months before his release. Defense Minister Katz had argued that after a decade, it is unreasonable for a combat soldier to continue paying a heavy price for an act committed during operational service.
