Driver Sentenced to 22 Years for Fatal Road Rage Shooting

A district court has sentenced Denis Mukin to 22 years in prison for the murder of Diyar Omri. Mukin was convicted of murder with indifference, along with charges of driving without a license, driving under the influence on two occasions, obstruction of justice, and malicious damage to a vehicle. He was also ordered to pay NIS 258,000 in compensation to the victim's family, received suspended sentences, and had his driver's license suspended for three years.

Mukin was initially charged with intentional murder but was convicted by a majority decision of murder with indifference. The court found that he was driving illegally and under the influence of drugs and alcohol when he tailgated Omri's vehicle. After an argument, Mukin stopped his car, exited with a handgun, and fired shots into the air. A physical altercation ensued, during which Omri attempted to disarm Mukin. Both men fell to the ground, and Mukin then shot Omri twice, with one bullet proving fatal.

Mukin fired three additional shots at Omri as he tried to reach his car, none of which hit him. The court determined that Mukin left the scene without offering aid or calling for help after Omri was wounded. Shortly thereafter, he returned with his sister and asked her to falsely tell police that she was driving, in an attempt to impede the investigation.

The judges emphasized that the incident began as a trivial dispute over driving behavior but escalated to the fatal shooting of a young man. They rejected the defense's claim of self-defense, stating that the appropriate sentencing range was 20 to 25 years. While Mukin's lack of prior criminal record and the extended pre-trial detention were considered mitigating factors, the court also noted his failure to accept responsibility or show remorse, his traffic offenses, and risk factors identified in a pre-sentencing report.
