Israel's Attorney General Defers Decision on Disqualifying Arab Candidate Sami Abu Shehadeh

Israel's Attorney General Gali Baharav-Miara and the State Prosecutor have submitted their position to the Central Elections Committee regarding disqualification requests against several parties and candidates. The Attorney General's office stated that there is no legal basis to disqualify parties such as Religious Zionism, Otzma Yehudit, Ra'am, and the Joint List, nor MK Ofer Cassif. However, concerning candidate Sami Abu Shehadeh, the Attorney General's office recommended that the Elections Committee "seriously consider" the disqualification request.

The basis for this recommendation stems from an article Abu Shehadeh published on October 8, 2023, which allegedly expresses support for a "weaponized struggle" by a terror organization against Israel. The Attorney General's office noted that Abu Shehadeh's response to the disqualification request did not alleviate concerns that the article reflected support for armed conflict against Israel at a critical time.

Despite these concerns, the Attorney General's office did not definitively rule on disqualifying Abu Shehadeh. Instead, they tasked the Central Elections Committee with weighing the request based on legal standards and arguments presented by Abu Shehadeh during their upcoming hearing.

Otzma Yehudit, one of the parties that requested Abu Shehadeh's disqualification, criticized the Attorney General's decision. A spokesperson stated that if the Attorney General cannot unequivocally call for his disqualification given the presented evidence, she is unfit for her role. Otzma Yehudit asserted that Abu Shehadeh and Ra'am must be removed from the Knesset, vowing to continue efforts to expel "terror supporters" from parliament.
