Court Reverses Sentence, Actor Dan Turgeman to Serve Prison Time

The Tel Aviv District Court has overturned a previous sentence for actor Dan Turgeman, ordering him to serve 10 months in actual prison for tax offenses committed between 2008 and 2017. Turgeman had previously been convicted based on his own admission as part of a plea deal.

His offenses included failing to report income from real estate ventures and property rentals. Additionally, a property he substantially owned was registered under another person's name, and capital gains tax was not paid upon its sale. Prosecutors argued the actions were deliberate attempts to evade taxes through fraud and deception.

Initially, the Magistrate's Court had set a sentencing range of 12 to 28 months but deviated, sentencing Turgeman to nine months of community service, six months suspended sentence, and a NIS 100,000 fine. The lower court cited the significant time elapsed since the offenses as a reason for leniency.

The State Prosecutor's Office appealed the lenient sentence, emphasizing Turgeman's systematic, long-term pattern of large-scale tax evasion over 12 years, involving various methods and active concealment of income from his accountant and tax authorities.

The district court panel, consisting of Deputy President Judge Shai Yaniv, Judge Yossi Tof, and Judge Dana Amir, accepted the state's appeal regarding the prison sentence. They stressed the binding legal precedent that tax evasion with intent to evade payment necessitates actual imprisonment, and that the passage of time does not justify deviating from this principle. The court noted that its revised sentence did not fully impose the harshest possible penalty.
