Court Reverses Lighter Sentence, Actor Dan Turgeman Sentenced to Prison for Tax Offenses

The Tel Aviv District Court has overturned a previous ruling, sentencing actor Dan Turgeman to 10 months in prison for tax offenses committed between 2008 and 2017. Turgeman had previously been convicted based on his plea in a deal, admitting to charges including omitting income from real estate ventures and property rentals, and failing to pay capital gains tax on a sold property.

The prosecution had argued that Turgeman deliberately evaded taxes through deceit and trickery over a 12-year period, engaging in systematic and ongoing criminal behavior. Evidence included his failure to issue invoices, conceal his full business activities from his accountant, and other active measures to hide income.

Initially, the Magistrate's Court had set a sentencing range of 12 to 28 months but ultimately imposed a sentence of 9 months of community service, plus a suspended sentence and a NIS 100,000 fine. The lower court cited the significant time elapsed since the offenses as a reason for leniency.

However, the prosecution appealed this lighter sentence, emphasizing the severity and duration of the tax evasion. The District Court judges, including Vice President Judge Shai Yaniv, Judge Yossi Tof, and Judge Dana Amir, agreed with the state's appeal regarding the prison sentence. They stressed a binding legal precedent that intentional tax evasion necessitates actual prison time, regardless of the time passed since the crimes.

The appellate court stated that its decision to impose 10 months, rather than a harsher sentence, was because the appellate court does not impose the full extent of the law. Turgeman's sentence will be served as actual prison time.
