Supreme Court Poised for Landmark Ruling on Balad Chairman's Knesset Candidacy

The Central Elections Committee has disqualified Sami Abu Shehadeh, chairman of the Balad party, from running in the 26th Knesset elections. The decision now rests with the Supreme Court, with legal sources anticipating a potentially unprecedented ruling that could uphold the disqualification. These sources indicated that the circumstances, particularly following the October 7th Hamas attacks, combined with the stances of the Attorney General and the Elections Committee chairman, are likely to lead the Supreme Court to a rare decision to approve the disqualification.

The committee's decision passed with a significant majority of 30 votes in favor and four against. Notably, Supreme Court Justice Noam Sohlberg, who chaired the committee, broke with tradition by participating in the vote and supporting Abu Shehadeh's disqualification. Sohlberg explained his departure from neutrality by stating he found no satisfactory response to the allegations against the Balad chairman.

The request to disqualify Abu Shehadeh was based, in part, on an article he published on October 8, 2023, where he described the Hamas terror attack as an "important historical event." Attorney General Gali Baharav-Miara announced her support for the disqualification, asserting that the evidence suggests he has expressed support for an armed struggle by a terror organization against Israel.

Abu Shehadeh has denied these accusations, stating during the hearing that he has never called for violence or terrorism and believes in peaceful means and persuasion within the law. Meanwhile, legal sources suggest that other disqualifications approved by the committee, including those of the Joint List, Ra'am, and MK Ofer Cassif, might be overturned by the Supreme Court, consistent with past precedents. However, the final decision in each case rests with the Supreme Court.

Should his disqualification be upheld, Abu Shehadeh might continue to lead Balad and operate outside the Knesset. The Balad party is reportedly scheduled to discuss this possibility, along with the option of appointing MK Bachar Ghattas, ranked second on the party list, as chairman.
