Israeli Military Court Rejects Appeal of Gaza Division Intelligence Officer Over Service Termination
The Israeli Administrative Court ruled on Tuesday against Lieutenant Colonel A, who served as the intelligence officer of the Gaza Division during the October 7, 2023 attack, rejecting his petition against the IDF's process to release him from permanent service. The court determined there is no legal impediment to continuing the administrative procedure examining his discharge from the military.
The case arose following IDF investigations and a review by a panel of experts led by retired Major General Sami Turgeman. On November 23, 2025, the Chief of Staff concluded that several senior commanders bore command responsibility for the events of October 7 and decided to take disciplinary measures against them, including Lieutenant Colonel A.
After the Deputy Chief of Staff recommended releasing Lieutenant Colonel A from his permanent service commitment, a committee was set to convene multiple times to review the case. However, the hearings were repeatedly postponed due to requests from the officer. On March 23, 2026, Lieutenant Colonel A petitioned the court to prevent the committee from convening. The court temporarily halted the committee's meeting and imposed a gag order on the proceedings, which was later lifted at the IDF's request.
In its ruling, the court affirmed that the process against Lieutenant Colonel A was lawful and based on findings of professional errors, failures, and command responsibility attributed to him. It also confirmed that military regulations permit termination of permanent service commitments in cases of professional or command failures and that the officer's right to present his case was preserved throughout the process.
Following the decision, the IDF announced it will immediately resume the administrative procedure to consider releasing Lieutenant Colonel A from service, marking a significant step toward concluding his military career.
