Israeli Court Rejects Gaza Division Intelligence Officer's Appeal Over October 7 Dismissal Process
An Israeli administrative court has rejected the appeal of a former intelligence officer of the Gaza Division, known as Lt. Col. A, who served during the Hamas attack on October 7, 2023. The court ruled that the Israel Defense Forces (IDF) may proceed with the administrative process to release him from his permanent service commitment. Following the ruling, the IDF announced it will continue the dismissal procedure and lifted a gag order previously imposed on the case.
The disciplinary action against Lt. Col. A stems from investigations and findings by a special expert team led by retired Major General Sami Turgeman. The investigations highlighted failures in handling the "Jericho Wall" plan and the intelligence warnings preceding the Hamas attack. IDF Chief of Staff Lt. Gen. Eyal Zamir determined that several senior commanders bore command responsibility for the events of October 7, recommending disciplinary measures. Lt. Col. A was the only officer slated for dismissal, while others received formal reprimands.
The dismissal process began after the Deputy Chief of Staff recommended releasing Lt. Col. A from his permanent service obligation. However, the review committee meetings were delayed multiple times due to requests from the officer. In March 2024, Lt. Col. A petitioned the court to halt the committee's convening, leading to a temporary injunction until the court's decision.
In its ruling, the court dismissed all of the officer's claims, affirming that the dismissal process was lawful and within the military's authority. It also confirmed that military regulations permit termination of permanent service due to professional and command failures, and that the officer's right to defense was preserved throughout the procedure.
The background to the case includes the Turgeman committee's findings that the "Jericho Wall" plan, which anticipated a large-scale invasion scenario, was known to the IDF years before the attack. Despite establishing a dedicated team in 2022 to review the plan, changes in command and the issue's disappearance from the agenda led to its stagnation, even as intelligence warnings continued.
Following the court's decision, the IDF is expected to promptly resume the administrative dismissal process against the former Gaza Division intelligence officer as part of the broader accountability measures stemming from the October 7 events.
