Israeli Court Rejects Appeal of Gaza Division Intelligence Officer Over Discharge Process Following October 7 Attacks
On March 31, 2026, an Israeli administrative court dismissed the appeal of the intelligence officer of the Gaza Division during the October 7, 2023 attacks, against the process to release him from his permanent service commitment in the Israel Defense Forces (IDF). The court also lifted a gag order on the ruling at the request of the IDF.
Following extensive military investigations and a review led by retired Major General Sami Turgeman, the IDF Chief of Staff decided on November 23, 2025, that several senior commanders bore command responsibility for the failures on October 7 and warranted disciplinary measures. The intelligence officer, identified as Lieutenant Colonel A, was among those commanders held accountable.
The discharge procedure began after the Deputy Chief of Staff recommended releasing Lieutenant Colonel A due to professional errors and command failures. Although a committee to consider ending his service was scheduled, it was delayed by requests from Lieutenant Colonel A. He petitioned the court on March 23, 2026, to halt the committee's convening, and a temporary injunction was granted.
The court ruled that the discharge process was lawful and within the military's authority, emphasizing that the officer's right to present his case was preserved. The IDF announced it would immediately resume the administrative process to release Lieutenant Colonel A from service. This decision marks a significant step in holding commanders accountable for the October 7 attacks.
