Israeli Court Rejects Gaza Division Intelligence Officer's Appeal, IDF Continues Discharge Process
The Israeli Administrative Court on Tuesday dismissed the appeal of Lieutenant Colonel A, the intelligence officer of the Gaza Division during the October 7, 2023 attacks, against the IDF's process to release him from permanent military service. The court ruled that the discharge procedure may proceed, and at the IDF's request, lifted a gag order that had previously restricted publication about the case.
This decision follows extensive IDF investigations and expert military reviews led by retired Major General Sami Turgeman, which found several senior commanders, including Lt. Col. A, responsible for command failures during the October 7 events. On November 23, 2025, the Chief of Staff decided to take disciplinary measures against these officers.
After the Deputy Chief of Staff recommended releasing Lt. Col. A from service, the discharge process began but faced delays due to multiple postponements requested by the officer. On March 23, 2026, Lt. Col. A petitioned the court to halt the committee meeting reviewing his case. The court temporarily suspended the committee and imposed a publication ban on the proceedings.
In its ruling, the court affirmed that the discharge process, initiated due to professional errors, operational failures, and command responsibility attributed to Lt. Col. A, was lawful and within military authority. It rejected all of the officer's claims and confirmed his right to present arguments was preserved throughout. Following the verdict, the IDF announced it will immediately resume the administrative process to terminate Lt. Col. A's service.
