IDF Central Command Chief Must Justify Refusal to Release Settler Held Under Administrative Detention

The Jerusalem District Court rejected an appeal by IDF Central Command Chief Major General Avi Blot and ordered the release of settler Tal Yinon Dradik, ruling that the administrative detention order against him was illegal. Defense Minister Israel Katz has instructed to cease using administrative detention orders against Jewish civilians in the West Bank and to address security concerns through other means. The legal dispute arose after Blot issued an administrative detention order against Dradik about a month ago, despite Katz's policy shift early in his tenure to end such orders against Jewish settlers.

The case escalated to the military court system, which initially ruled the detention order unlawful. Blot appealed to the civilian district court, which upheld the military court's decision and canceled the order. The court gave Blot until Monday at 11:00 a.m. to file another appeal before Dradik's release is enforced. Katz's office emphasized that the political leadership's policy is clear: due to serious procedural flaws in issuing the order, the minister instructed not to renew it and to seek alternative measures.

The settler advocacy group Honenu, representing Dradik, praised the court's decision, calling the detention "baseless and without evidence." The case highlights a growing rift between the political leadership and the military command in the West Bank over the use of administrative detention against Jewish civilians. Blot now faces a choice whether to continue legal efforts to prevent Dradik's release or comply with Katz's directive to discontinue such orders.
