Israeli Election Committee Disqualifies MK Ofer Cassif, Case Heads to Supreme Court

The Central Elections Committee (CEC) of Israel has voted to disqualify Knesset Member Ofer Cassif, representing the Hadash-Ta'al bloc, from participating in upcoming parliamentary elections. The decision, which passed with 19 votes in favor and 5 against, with 2 abstentions, cites Cassif's alleged support for armed struggle by terrorist organizations and hostile states against Israel. The Likud party spearheaded the disqualification effort, with its attorney, Ilan Bombach, presenting evidence of Cassif's statements, including support for the Palestinian resistance, signing onto South Africa's lawsuit against Israel at the International Court of Justice, and controversial remarks during recent hostilities. Bombach argued these actions demonstrate a denial of Israel's Jewish and democratic character.

However, the government's legal advisor, Gali Baharav-Miara, and State Prosecutor Amit Eisman opposed the disqualification. Their official opinion stated that the available evidence does not meet the stringent criteria outlined in Basic Law: The Knesset, Article 7A, which governs candidate disqualifications.

Ofer Cassif vehemently denied the accusations, asserting that he publicly condemned the Hamas attack on October 7, 2023. He argued that criticizing the Israeli government and military does not equate to supporting enemies and that the disqualification attempt aims to dismantle Arab-Jewish political partnership in Israel. The CEC's decision is not final and will be forwarded to the Supreme Court for review. The Supreme Court has previously set a high bar for disqualifications, requiring clear and substantial evidence. In a similar instance before the 2019 elections, the committee attempted to bar Cassif, but the High Court of Justice overturned the decision due to insufficient evidence.
