President Herzog Expunges Criminal Record for Elor Azaria

President Isaac Herzog signed off on shortening the criminal record period for Elor Azaria on Saturday evening, just before Yom Kippur, following a request from Azaria and a recommendation from Defense Minister Israel Katz. The President's Residence emphasized that this decision does not alter the conviction itself or constitute a review of the legal proceedings.

According to the President's Residence, Herzog considered all aspects of the case, including the time elapsed since the incident, Azaria's completion of his sentence, the statute of limitations for the offenses, and changes in his personal and family circumstances. The President's Residence also noted Azaria's desire to overcome employment barriers and start anew, stating that Azaria expressed respect for IDF values and a wish to raise his two children accordingly, while also conveying regret for the incident's consequences.

The decision also took into account Azaria's previous letter to former President Reuven Rivlin, where he described the shooting as a "operational mistake" in hindsight and stated he would not have carried it out. Complex medical issues faced by the Azaria family over the years were also considered.

However, the President's Residence reiterated that shortening the record does not question the legal process, emphasizing the military court system's importance in upholding the rule of law and IDF values, particularly the principle of the purity of arms. The President's Residence clarified that the pardon authority is a "institution of grace" and not an appellate court.

The decision comes nearly a decade after the incident, during which Azaria served his sentence, which was previously shortened by then-Chief of Staff Gadi Eisenkot. After reviewing past and present considerations, Herzog decided to accept the Defense Minister's recommendation for immediate shortening of the criminal record period.
