Netflix Defends Israeli Filmmakers Against Tyra Banks' Defamation Lawsuit Over Documentary

Netflix has filed a motion to dismiss a defamation lawsuit brought by Tyra Banks concerning a documentary about "America's Next Top Model" directed by Israeli filmmakers Mor Loushi and Daniel Sivan. Banks sued in June, alleging the documentary falsely portrayed her as insensitive toward a contestant who claimed sexual assault during the show's second season in Milan. The documentary, released in February, used about 16 minutes of Banks' three-hour interview and highlighted critical perspectives on the show and Banks' demanding standards.

Netflix argues that Banks' claims stem from routine editorial decisions typical in reality TV production, decisions Banks herself made during her 24 seasons as creator, host, and producer of the show. The streaming giant's legal team stated that Banks' disagreement with her portrayal does not constitute defamation. They also noted Banks signed a standard waiver relinquishing creative control over the project.

Banks' attorneys contend the documentary edited her interview misleadingly, omitting parts that would clarify her memory of the contestant, Sandy Sullivan. Netflix responded that Banks' acknowledgment of Sullivan's story appears in the second episode. Banks' lawyer, Tom Clare, challenged Netflix to release the full unedited interview to prove the documentary's accuracy, emphasizing the issue is whether the editing distorted the truth rather than mere dissatisfaction with editorial choices.

The three-part documentary revisits the controversial aspects of "America's Next Top Model," which aired from 2003 to 2018, and scrutinizes Banks' role in enforcing an unrealistic model ideal. Netflix affirmed its support for the filmmakers and the documentary, stating they fairly presented Banks' perspective alongside others. The legal dispute continues as Netflix seeks to dismiss the lawsuit, while Banks demands accountability for what she claims is a false depiction.
