Israel's Election Committee Debates Arab Candidates' Eligibility Under Law

Israel's Central Elections Committee has disqualified several Arab candidates and lists from participating in upcoming elections, citing violations of Basic Law: The Knesset, specifically Article 7a, which prohibits candidates who deny Israel's existence as a Jewish and democratic state, incite racism, or support armed struggle against Israel. The decisions, made on September 23, are automatically referred to the Supreme Court for ratification, while challenges to list disqualifications can also be brought before the court.

The committee's decisions have sparked debate over the consistent application of legal standards, particularly concerning the sufficiency of evidence. In the case of Sami Abu Shehadeh, the disqualification request is based on an article he published on October 8, 2023. Legal analysts question whether a single article constitutes sufficient grounds, noting that the Supreme Court has historically required a "critical mass" of evidence demonstrating that support for armed struggle is a central aim of a candidate's activity, not a marginal one. Abu Shehadeh maintains the article was "unfortunate" but not an endorsement of violence, arguing his defense rests on his long-standing political positions and that initial knowledge of events might have influenced his decision to publish.

Similarly, Ofer Cassif was disqualified for allegedly supporting armed struggle, a case that carries significant precedent. The Supreme Court overturned a previous disqualification of Cassif in 2019, deeming the evidence insufficient. The current case will test whether new evidence meets the higher threshold required by the court, which has previously rejected a small number of articles as grounds for disqualification.

Beyond individual candidates, the Joint List and the Unified List were also disqualified by the committee. Political analyst Dr. Salim Brake suggests these decisions have implications beyond the current election, potentially affecting Arab political representation and voter turnout, even if overturned by the Supreme Court. He characterizes the Elections Committee as primarily a political body.

In a separate decision, the committee rejected a request to disqualify the Otzma Yehudit party, despite allegations of denying democracy and inciting racism. The legal advisor noted some statements by Itamar Ben-Gvir were concerning but did not meet the threshold for disqualifying the entire list, distinguishing between personal remarks and legal grounds for disqualification. Historically, the Supreme Court has handled candidates from this party differently, sometimes upholding disqualifications for incitement while rejecting others due to insufficient proof, emphasizing that the nature and accumulation of evidence are decisive.

As these cases move to the Supreme Court, legal experts anticipate a more cautious review. The court has historically overturned numerous disqualification decisions since 2003, emphasizing that disqualification is an exceptional measure requiring strong, cumulative evidence of a prohibited objective central to a candidate's activities.
