The Israeli Supreme Court will review the Arrest Freeze Law, which protects yeshiva students from military detention, amid criticism of judicial overreach rooted in Aharon Barak's 1992 constitutional revolution. Attorney Yoram Sheftel condemned the court's power to overturn democratically passed laws and called for a constitutional crisis to limit the court's influence. The law aims to balance ultra-Orthodox religious exemptions with military service requirements.

The Israeli Supreme Court is scheduled to hear a case tomorrow concerning the legality of the Arrest Freeze Law, which aims to prevent the detention of yeshiva students and establish criteria for "Torato Omanuto" status, similar to exemptions granted to elite athletes. This law was enacted following a Supreme Court ruling that removed the legal basis for blanket exemptions for yeshiva students from military service.

Attorney Yoram Sheftel, interviewed ahead of the hearing, criticized the Supreme Court's authority to invalidate laws passed democratically by the Knesset. He traced the court's power back to the 1992 "constitutional revolution" led by former Supreme Court President Aharon Barak, who expanded the interpretation of human dignity and liberty to include values such as equality and freedom of expression. Sheftel argued that this judicial activism undermines elected officials by allowing unelected judges to impose their moral and democratic values.

Sheftel also highlighted the lack of broad consensus in the 1990s regarding the inclusion of equality as a constitutional value, quoting committee members who warned about the unpredictable reach of such judicial interpretations. He warned that besides the Arrest Freeze Law, the Supreme Court might also strike down the Gender Separation in Higher Education Law.

To counter what he described as the "dictatorship of the Supreme Court," Sheftel proposed a constitutional crisis as the only viable solution, urging political leaders to choose the right moment to resist court rulings that the government and Knesset refuse to implement.

The Arrest Freeze Law reflects ongoing tensions over the integration of the ultra-Orthodox community into military service, balancing religious lifestyle accommodations with national service obligations.
