A Tel Aviv District Court has ordered four homeowners in a Givatayim apartment building to sign a "pinui-binui" (evacuate-and-build) redevelopment agreement within 30 days, or court-appointed lawyers will sign on their behalf. The ruling came after 28 of the 32 apartment owners in the building at 4-10 HaMa'avak Street sued the remaining four who had refused to sign the deal.
The four dissenting owners had argued that the new apartments they were slated to receive under the redevelopment plan were insufficient and that their building rights should be factored into the compensation. These rights stemmed from a 1998 plan approved for the building that allowed for apartment expansions, which these four owners had not utilized at the time. They claimed the current deal unfairly disadvantaged them compared to owners who had previously expanded their units, even though the agreement reportedly offered them a larger addition than those who had expanded.
The court rejected the defendants' claims, ruling that the compensation offered was not discriminatory and that their demand for larger apartments than stipulated in the agreement was unfounded. The "pinui-binui" project aims to demolish the existing building and construct a new one, providing larger apartments to the original owners as compensation.
