Israeli Court Cancels Conviction of Father Who Assaulted Daughter After Late Night Out
An Ashkelon Magistrate's Court recently overturned the conviction of a 43-year-old father who assaulted his daughter after she returned late from a night out, causing her to bleed from the nose. The father had admitted to and was initially convicted of causing actual bodily harm. According to the indictment, the daughter returned home around 4 a.m. but stayed outside with friends. At 6 a.m., the father called her and demanded she come inside, then allegedly dragged her to a room and struck her multiple times in the face.
Despite the severity of the incident, the probation service recommended canceling the conviction and imposing community service, citing the father's significant therapeutic progress and the daughter's willingness to renew their relationship. The prosecution, represented by Attorney Amit Hamari, opposed this, arguing the father did not meet legal criteria for conviction cancellation and should receive a suspended prison sentence.
Defense Attorney Limor Rot-Hazan presented five positive reports supporting cancellation and highlighted the severe professional harm the father suffered due to the criminal proceedings, including difficulties maintaining his self-employed work. Judge Zvi Porer emphasized the father's lack of prior convictions and the isolated nature of the incident, noting the daughter is expected to remain an important part of his family. He ruled that maintaining the conviction would cause disproportionate harm relative to the offense.
The court rejected the prosecution's request to uphold the conviction, considering the father's clean record and the significant damage to his livelihood. The judge sentenced him to 180 hours of community service, a one-year probation order, and a 3,000 shekel commitment to avoid violent offenses. Defense counsel stated that even serious cases can end without a criminal record when the harm of conviction outweighs its benefits, especially for a one-time lapse by otherwise law-abiding individuals.
