The Supreme Court of Israel on Thursday dismissed three petitions challenging the appointment of Yehuda Eliyahu as acting director of the Israel Land Authority (ILA). This ruling concludes the legal proceedings against his appointment.

Earlier this week, the court had rejected a request by Finance Minister Bezalel Smotrich and Housing Minister Haim Katz to allow further proceedings for appointing a permanent director during the election period, thereby preventing the government from acting against the Attorney General's position. Consequently, the current government cannot permanently appoint Smotrich's candidate, Yehuda Eliyahu, who is currently serving as acting director.

The petitions were filed by the Movement for Quality of Government, the Arab Center for Alternative Planning, the Association of Women's Organizations in Israel, Na'amat, and the Religious Women's Association. Justices Yael Vilner, Ofer Groskopf, and Khaled Kabub accepted the state's argument that disputes of this nature should primarily be resolved through dialogue among relevant government parties, rather than through further court appeals after a final judgment.

The justices clarified that their previous suggestion related to appointing an acting director according to Section 23A(c) of the Civil Service Law (Appointments), effective July 22, the scheduled end of the interim appointment period. However, the current ruling does not make a fundamental decision on the legality of the appointment or the powers of the involved parties, focusing instead on resolving the dispute that arose from the prior proceedings.

Finance Minister Bezalel Smotrich welcomed the decision, stating, "Moving the settlement revolution from Judea and Samaria to the Negev and Galilee is critical and significant for the future of the State of Israel. One of the main tools for this is the Israel Land Authority, and I am glad that Yehuda Eliyahu, who has demonstrated impressive execution and achievement capabilities, will continue in his role to move the revolution to the Negev and Galilee." Smotrich's office presented the dismissal of the petitions as a victory, emphasizing that Eliyahu can continue as acting director, thereby removing the legal obstacle to his tenure.
