Israel's Supreme Court has denied a request by Prime Minister Binyamin Netanyahu, Finance Minister Bezalel Smotrich, and Construction and Housing Minister Haim Katz to expedite the appointment of Yehuda Eliyahu as the permanent director of the Israel Land Authority (ILA).

The court ruled that the previous ruling, which was based on a compromise between the parties, did not address the issue of advancing a permanent appointment during an election period. The judges stated that the current proceedings could not be used to decide this matter through an immediate implementation of the prior verdict. They advised the Prime Minister and ministers to pursue the matter through "accepted channels" if they disagreed with the legal counsel's position.

Eliyahu was initially appointed as the permanent director in March but the Supreme Court overturned this appointment two months ago, citing concerns over conflicts of interest and Eliyahu's significant ties to Finance Minister Smotrich. Following the cancellation, Eliyahu was appointed as the acting director on a temporary basis.

Netanyahu, Smotrich, and Katz had sought the court's permission to resume the selection process for a permanent director, contrary to the legal advisor's stance against filling senior positions during elections. They argued that the prior court decision did not preclude continuing the appointment process now.

The legal dispute is intensified by Eliyahu's temporary tenure, which is set to end in two days. According to a legal opinion from Efrat Prokcha, the legal advisor to the Ministry of Construction and Housing, extending his term through the usual channels faces significant legal hurdles. This is partly because the maximum six-month period for an acting director has been exhausted, considering the tenure of the previous acting director, Idan Moalem.

Further complicating matters, Eliyahu has been summoned for a hearing by Minister Haim Katz regarding his performance. The appointment of any other acting director would also require special approvals and justification. The Israel Land Authority, responsible for managing state lands and a significant portion of land marketing for construction, remains at the center of a political and legal battle over its leadership.
