Ponovezh Yeshiva Dispute Escalates to Supreme Court Ahead of Eviction Deadline

Two days before a court-ordered eviction deadline, a faction within the Ponovezh Yeshiva has filed an urgent appeal to Israel's Supreme Court. The appeal, submitted by the 'Tradition of the Torah' association on behalf of Rabbi Gershon Weiss, seeks to delay the evacuation of the yeshiva complex, which was mandated by the Tel Aviv District Court.

The District Court, presided over by Judge Yehudit Shevah, had previously upheld an arbitration ruling by retired judge David Hashin. This ruling ordered Rabbi Gershon Weiss's followers to vacate the yeshiva premises by Wednesday, September 30th. The court rejected a request to overturn the arbitration award, which was filed by the 'Tradition of the Torah' association, Rabbi Gershon Weiss, and his wife, Tzipora Weiss.

In addition to the eviction order, the arbitration award prohibits Rabbi Gershon Weiss's faction from using the yeshiva's trademarks, including its name and logo. He is also forbidden from presenting himself as the "Rosh Yeshiva" (head of the yeshiva). The faction had argued that the arbitrator exceeded his authority and that the ruling infringed upon Rabbi Weiss's historical rights established in earlier arbitration proceedings.

The District Court dismissed these claims, fully validating Hashin's decision. The original eviction date set by the arbitrator was the end of July, but Judge Shevah extended it due to the proximity of the High Holidays, expressing hope for a peaceful resolution.

With the deadline looming, the Supreme Court's decision on the request for a stay of execution will determine whether the eviction proceeds this week or is postponed pending a full hearing of the appeal.
