Defense Tactics Challenge Murder Charges in Benayahu Razee Case
Defense attorneys for the suspects accused in the murder of Benayahu Razee have secured a tactical victory, compelling prosecutors to present their evidence for the murder charge first. The defense argues that the prosecution's evidence, particularly regarding the suspects' alleged knowledge of being armed, is insufficient to support a murder conviction and a life sentence.
One defense lawyer, Stern, representing suspect Agam Tzarafi, stated that the defense intends to argue a lack of prima facie evidence for murder. He explained that the court granted their request to reverse the order of arguments, requiring the prosecution to present its case first. Stern further argued that Tzarafi lacked the intent or the ability to foresee that the events would escalate to murder, asserting she had no awareness that the situation would lead to a killing.
Another defense attorney, Amit Weitzman, representing Shilat Huta, adopted an even stronger stance. He challenged the prosecution to clarify if the sole evidence against Huta for murder is her alleged knowledge that others were armed. Weitzman contended that even if Huta knew the others were armed, this knowledge does not establish the necessary intent for murder, arguing that solid evidence is required for such a serious charge. He also disputed that Huta was aware of the arming, suggesting any such admission was coerced during interrogation.
Weitzman stated that the defense's primary goal is Huta's release, requesting the court to rule there is insufficient evidence against her for murder. The lawyer for another suspect, Linor Sasson, who is not directly accused of murder but related offenses, also sought her release, suggesting the case's high media profile has prolonged her detention.
The court has yet to rule on these requests. The legal battle is expected to focus on the existence of prima facie evidence for murder, with the prosecution needing to detail its case before the defense presents its arguments for dismissal.
