Man Sentenced to Life in Prison for Murder of Woman in Front of Daughter

A Nazareth court has sentenced Nidal Dagher to life imprisonment for the premeditated murder of Rasha Sitawi in her home in Maghar on November 25, 2021. Dagher will also serve an additional four years, with two years served concurrently and two consecutively, effectively adding two years to his life sentence. He was also convicted of child abuse, obstruction of justice, and other offenses.

Dagher arrived at Sitawi's home wearing a helmet to conceal his face and carrying a loaded pistol. He entered the home and approached Sitawi, who was with her approximately 10-and-a-half-year-old daughter. The victim attempted to hide behind her daughter as she screamed, but Dagher shot her in the head from less than two meters away. He then approached her again and fired two more shots at close range to ensure she was dead. The daughter witnessed the entire event.

The prosecution emphasized that the child abuse was a separate offense, not merely incidental to the murder. They argued that exposing the child to such extreme violence in her own home, where she should have felt safe, constituted significant psychological harm. The prosecution requested a separate penalty for the child abuse, to be served consecutively with the life sentence.

The court accepted the prosecution's argument, ruling that the child abuse was a distinct act requiring a substantial additional penalty. The court stated that the child was not only an orphan but a direct victim forced to witness her mother's murder. The severe psychological damage is presumed and expected to have lifelong repercussions, necessitating an independent sentence to reflect the severity of the act and deter others.

In determining the sentence, the court considered Dagher's criminal record, which includes convictions for illegal weapon possession, arms trafficking, obstructing police, and reckless driving. He also had a history of driving offenses, including driving with a suspended license and without insurance. The court noted that Dagher showed no remorse or responsibility for his actions and did not express regret before the sentencing.
