Supreme Court Clears Path for State Prosecutor to Conclude 'Patzarit' Case

The Israeli Supreme Court has cleared the way for the State Prosecutor, Amit Isman, to make a final decision in the "Patzarit" (former military advocate general) case. The court rejected a request for an additional hearing, effectively lifting a freeze on the case's advancement.

Justice Daphne Barak-Erez, in her decision, stated that the requests for an additional hearing did not warrant a response and could be dismissed. She emphasized that such hearings are exceptional and reserved for unique situations where a new precedent is set or a previous one is challenged due to its complexity or importance. Barak-Erez found no new or significant precedent established in the ruling that would justify further deliberation.

Barak-Erez also addressed arguments concerning the Justice Minister's authority in the case. She clarified that the minister's decisions related to transferring oversight of the leak investigation to another body, not directly to appointing a special prosecutor for the investigation. Therefore, she stated, the claim that appointing such a prosecutor was necessary was unfounded. The minister's authority, under the "Guardians of Democracy" law, was limited to appointing a supervisory official.

She further noted that the applicants' argument, that the Justice Minister was the authorized party to determine or remove a conflict of interest, was not fully supported by previous rulings. The "Guardians of Democracy" ruling considered the minister's decision based on a legal opinion and did not grant the minister discretion over determining the conflict itself. Instead, the ruling aimed to set clear limitations on political interference in investigations. Barak-Erez expressed hope that the case could now be concluded according to the law.
