Agudat Yisrael Challenges Ban on Voter Tracking, Citing 40-Year-Old Practice

Agudat Yisrael, a Haredi political party in Israel, submitted a detailed response opposing the Central Elections Committee chairman Judge Noam Solberg's recent ruling that prohibits parties from recording the identities of voters who have already cast their ballots. The party's legal representative, Attorney Avraami Yustman, revealed that Agudat Yisrael pioneered the voter tracking method over 40 years ago using "Alef sheets," paper forms with numbered boxes to mark voters who had participated. This system helped the party manage voter turnout efficiently, particularly among yeshiva students who prioritize uninterrupted Torah study.

The party explained that knowing who has voted allows them to direct voters to less crowded polling stations, minimizing wait times and preserving study time. Over time, the tracking evolved to use secure kosher phones and computerized systems, maintaining the same goal of efficient voting without disrupting religious commitments. Yustman criticized Judge Solberg's characterization of the tracking tool as insignificant, emphasizing the high stakes of election day and referencing the Likud party's reported investment of around 2 million shekels in a similar app.

Agudat Yisrael also addressed concerns about privacy versus secrecy, clarifying that while voter choice secrecy is protected, the fact that a person voted is not confidential. Yustman illustrated this with a banking analogy, noting that being seen at a bank does not reveal transaction details, similar to how voting presence is public but vote choice is secret.

To address fears of data leaks, Agudat Yisrael proposed three alternatives: centralized voter tracking managed by the Elections Committee with secure apps and equal data sharing; reverting to the original physical "Alef sheets" method to avoid digital leaks; and a voluntary reporting system where voters can choose to confirm their voting status outside the polling station. The ruling is expected to significantly impact Haredi parties' ground operations, which rely on real-time voter turnout data to mobilize supporters. The party's response aligns with other political figures who have condemned the decision as a severe blow to democracy.
