The Israeli Supreme Court has upheld the sentences of the main defendants involved in a brutal gang rape case that occurred on August 12, 2020, at the Red Sea Hotel in Eilat. The court, led by Justice Stein with agreement from Justices Khaled Kabub and Ruth Ronen, ruled on appeals filed by a group of minors and adults convicted of multiple sexual offenses against a 16-year-old girl, including rape, aiding rape, and aggravated indecent acts. While the court maintained the harsh sentences for the primary perpetrators, it reduced penalties for several other involved individuals, most of whom were minors.

The victim, who was heavily intoxicated and unable to consent, was forcibly taken to room 216, stripped, and repeatedly raped by four men. Numerous bystanders witnessed the assault, some entering the room, encouraging the attackers, and even assisting in the crime. Justice Stein emphasized that all those who enabled or encouraged the acts bore responsibility. Video evidence, including footage recorded by one of the convicted men, confirmed the victim's inability to consent.

The court detailed the sequence of events, noting the victim had been drinking heavily with friends in room 223 before being led to room 216 under false pretenses. The violence escalated as more individuals joined the assault, including a minor and his twin brother. The victim was left unconscious and was later helped out of the hotel by friends.

Justice Stein rejected defense claims as baseless and explained the rationale for reducing sentences for minors, citing legal obligations to prioritize rehabilitation and impose relatively moderate prison terms on juvenile offenders. He contrasted this case with the 1988 American film "The Accused," which portrayed a similar gang rape scenario but where only the rapists were convicted, not the spectators. In this Israeli case, nearly all the onlookers and facilitators were sentenced to prison.

Stein highlighted the profound psychological damage inflicted on the victim, noting that sexual assault undermines a victim's basic sense of security and control over their life, with lasting internal effects. He expressed hope that the court's decision would contribute to the victim's recovery.
