Jerusalem District Court Allows Advancement of 'Jerusalem Burj Khalifa' Tower Project

The Jerusalem District Court, sitting as the Administrative Court, rejected on Monday the petition filed by 35 residents and Jerusalem City Council members against the "Epstein Complex" plan, commonly known as the "Jerusalem Burj Khalifa." The court upheld the decisions of the Jerusalem District Planning and Building Committee and the Subcommittee for Appeals of the National Council, which had approved the project's advancement.

Designed by the international architectural firm Adrian Smith + Gordon Gill, which also designed Dubai's Burj Khalifa, the project includes a 165-meter, 42-story residential tower alongside commercial, hotel, public buildings, a city square, and a public observation deck. The project has sparked significant public controversy due to its proximity to Mount Herzl and Yad Vashem and its potential impact on Jerusalem's skyline.

The court ruled that the planning bodies conducted a thorough, professional, and reasoned process, balancing development needs with landscape, preservation, and heritage values. The plan aligns with policies promoting densification along the light rail corridor and contributes to increasing housing supply while offering substantial public benefits. The tower's height was reduced from approximately 200 meters to address sensitivities related to nearby national sites.

The judges dismissed claims of significant procedural or factual flaws, noting that committees conducted site visits, considered alternatives and visual simulations, heard public objections, and acknowledged the area's sensitive nature, including its importance to bereaved families. The court found no legal defect or extreme unreasonableness warranting intervention. It also rejected arguments that the project would severely harm views from the Ein Kerem neighborhood or contradict other regional plans. The decision to allow a height deviation was upheld due to the project's unique location, architectural qualities, and expected public benefits.

With the petition denied, the path is clear for the project's continued promotion, subject to completing the necessary licensing procedures.
