The Israeli Supreme Court has yet to define the legal boundaries of WhatsApp group administrators' responsibility for defamatory content posted by members. A current appeal from a Tel Aviv Magistrate's Court ruling may prompt the Supreme Court to clarify these issues. The case involves Doron Ben Shimon suing Anath Kleinman, Beni Bashan, and Yom Tov Tamir, administrators of WhatsApp groups for veterans of the 1973 Yom Kippur War's 9th Battalion, over defamatory posts accusing Ben Shimon of abandoning comrades during a fierce battle at the Orkal outpost near the Suez Canal.

Two WhatsApp groups, "9th Battalion Forever" managed by Bashan and Kleinman, and "50th Reunion Group" created by Tamir, the battalion commander awarded the Medal of Valor, became platforms for harsh accusations. A member, referred to as "the publisher," accused Ben Shimon of fleeing the battlefield and abandoning his tank and comrades, calling him a war criminal and other severe insults. Ben Shimon refrained from suing the publisher due to concerns about the publisher's fragile mental health and suicide risk, reportedly advised by Tamir and Professor David Ezra, a former battalion doctor and current head of PTSD committees at the Defense Ministry.

Ben Shimon claimed the defamatory posts caused him severe distress, nearly leading to suicide. Despite Tamir's public apology to Ben Shimon in March 2022, the abuse continued, prompting Ben Shimon to leave the groups in June 2023. Judge Yair Delugin of the Tel Aviv Magistrate's Court ruled the posts constituted defamation, rejecting defenses of truth and good faith opinion, and held the group admins responsible for failing to remove the harmful content. Damages were awarded: Kleinman 20,000 shekels, Bashan 40,000, and Tamir 30,000.

The defendants appealed, arguing no direct dispute existed since Ben Shimon did not sue the publisher, the posts were not fully presented in court, and that admins of open groups cannot be held liable for third-party messages without prior control or removal ability. They also cited freedom of expression. Current case law suggests group admins may be liable if they knew of defamatory posts and failed to act. The judge criticized the admins for removing Ben Shimon instead of the publisher and for delayed action after multiple defamatory posts.

This case highlights the complex intersection of online group management, defamation law, and the psychological scars of war veterans. It may set important precedents for digital platform responsibility in Israel once the Supreme Court rules.
