Israeli Parliament Legal Advisor Requires MPs to Disclose Relatives Avoiding Military Service Before Voting on Draft Law

Ahead of the vote on a new military service bill concerning yeshiva students who avoid conscription, the Knesset's legal advisor, Attorney Shagit Afik, issued a directive to members of parliament. The bill proposes mechanisms to freeze arrests of yeshiva students who refuse military service, halt legal proceedings against them, and prevent prosecution for draft evasion. Afik highlighted that these provisions could directly affect the legal status of individuals subject to conscription enforcement.

Afik stated that if an MP has a close relative who is under arrest, has an outstanding arrest warrant, or is involved in ongoing enforcement or legal proceedings related to draft evasion, the MP must disclose this potential conflict of interest before participating in debates or voting on the bill. However, she clarified that after such disclosure, MPs are still permitted to take part in the vote, as parliamentary ethics rules do not prohibit their participation.

The legal advisor emphasized that the responsibility to avoid conflicts of interest lies with each MP based on their personal and family circumstances. She also noted that having relatives who are yeshiva students not yet subject to arrest warrants or enforcement actions does not require disclosure, since this group is large and general.

This guidance comes as the Knesset prepares to vote on the controversial legislation, which has sparked significant debate regarding military service exemptions for ultra-Orthodox yeshiva students. The disclosure requirement aims to ensure transparency and address concerns about potential conflicts among lawmakers voting on the bill.
