Israel's Capital Markets, Insurance and Savings Authority has finalized a directive preventing car insurance companies from discriminating against drivers based on their residential address. Insurers must now provide statistical proof to justify any price differences or coverage refusals linked to geographic location. This move addresses complaints of unfair practices, particularly in Arab communities and peripheral areas, and clarifies existing anti-discrimination laws. The directive applies to all types of car insurance and aims to ensure fairer pricing for policyholders.

  • Israel's insurance regulator banned car insurance price hikes or denials based solely on driver's address.
  • Insurers must provide statistical proof to justify risk differences by geographic area.
  • The directive addresses complaints of discriminatory practices in Arab communities and peripheral areas.
  • Requiring a clean insurance history longer than three years is now an impermissible practice.
  • The ruling applies to all types of car insurance, including mandatory and comprehensive coverage.

Israel's Capital Markets, Insurance and Savings Authority has issued a final directive prohibiting car insurance companies from charging higher premiums or refusing coverage based solely on a driver's place of residence. The ruling, released nearly two years after a draft was first published, clarifies existing law rather than introducing new prohibitions. It states that insurers cannot deny coverage, impose unusual demands, or charge more due to a policyholder's address without statistical research to justify a difference in risk.

The directive was prompted by complaints from drivers, particularly in Arab communities and peripheral areas, who faced difficulties obtaining insurance. Insurance agents had reported that some companies were blocking online purchases or requiring stringent underwriting processes. One instance involved a potential policyholder whose insurance purchase was blocked online when their address was changed from Afula to the nearby Arab village of Ilut, despite other details remaining the same, necessitating a manual underwriting review.

Another practice addressed is the demand for a clean insurance history spanning five years, exceeding the three-year period covered by the government's "Har Bituah" database. The Authority clarified that requiring a clean history longer than three years is an impermissible practice. The new stance also explicitly states that insurers cannot use a policyholder's residential area as an underwriting variable or for pricing unless they can prove through statistical studies that the risk level differs based on geographic area.

This clarification comes amid a surge in car thefts across Israel, which has been a significant factor in the rising cost of comprehensive car insurance between 2022 and 2024. While some areas, like Kfar Saba, have reported high rates of vehicle theft (29.7 per 1,000 vehicles in late 2024), the Authority's directive raises questions about whether such aggregate data is sufficient to justify differential pricing for all residents of an area, considering individual driving habits and vehicle usage patterns.

It remains unclear what specific statistical studies will be deemed sufficient by the Authority, whether insurers can rely solely on their own claims data, and how the influence of other risk factors will be assessed. The directive applies to mandatory, comprehensive, and third-party liability insurance, whether purchased directly or through an agent. The Authority intends to enforce this interpretation of the law against discriminatory practices based on residency.
