Israel's Supreme Court has upheld the demolition of a terrorist's home in Na'ama, establishing a precedent that allows for such actions even when planned attacks fail to cause casualties. The ruling concerned Abd Allah Mahmoud Saud Al-Hateeb, who was involved in manufacturing explosives and planning rocket attacks. His family appealed the demolition order, citing the lack of casualties and delays, but the court ruled that the severity and lethal potential of his actions justified the measure for deterrence purposes. The decision fully rejected the appeal, allowing the demolition to proceed.

Israel's Supreme Court has unanimously rejected an appeal by the family of terrorist Abd Allah Mahmoud Saud Al-Hateeb, upholding a demolition order for his residence in the village of Na'ama. The ruling, delivered by Justice Yael Vilner, establishes a significant precedent, allowing for the destruction of a terrorist's home even when a planned attack fails to cause casualties.
Al-Hateeb was involved for years in manufacturing explosives and rockets, leading a cell with the aim of launching frequent attacks against Israeli communities, in support of Hamas and its October 7, 2023 massacre. On September 17, 2025, the cell targeted Modi'in Illit with two rockets. However, a technical malfunction caused one rocket to fall and disable the other, preventing the attack by chance. Al-Hateeb is also linked to an October 9, 2023 incident where a drone dropped an explosive device that detonated over people in Sde Ephraim.
The appeal was filed by Al-Hateeb's wife and two minor children, who argued that the demolition order exceeded standard policy due to the lack of casualties and significant delays in its issuance. The state countered that the attack was strategically dangerous and only narrowly avoided disaster, requiring special approval from the Prime Minister and Defense Minister due to its exceptional nature and the operational demands on security forces.
Justice Vilner dismissed the family's claims, stating that the severity and lethal potential of Al-Hateeb's actions justified the use of Defense (Emergency) Regulations, Article 119, which empowers military commanders to order the demolition of terrorists' homes. She emphasized that the deterrence purpose of home demolitions supersedes the outcome of the attack, asserting that an offender who did everything to complete their act, even if unsuccessful, is equivalent to one who completed it.
Regarding the terrorist's minor children, the court ruled that deterrence and saving future lives outweigh the difficult consequences for them. The request to seal only one room instead of demolishing the apartment was also denied. The court acknowledged the military's partial concession, limiting the order to Al-Hateeb's ground-floor apartment and excluding adjacent units and other floors. The demolition will proceed with strict safety protocols.
Justice Ruth Ronen concurred, analyzing the proportionality of the demolition. She noted that despite no alleged involvement of the wife and children, Al-Hateeb's direct connection to his residence and the scope and systematic nature of his terror activities were decisive factors. The Supreme Court's decision fully rejected the appeal, lifting the temporary order and paving the way for the apartment's demolition.
