A Tel Aviv District Court judge has sharply criticized the state and the IDF for repeatedly failing to provide basic data regarding the enforcement of mandatory military service, particularly concerning draft dodgers from the Haredi (ultra-Orthodox) community. Judge Limor Bibi expressed frustration during a hearing on a petition concerning the issue, stating, "Court decisions are not a recommendation." The IDF has struggled to answer fundamental questions about the number of draft dodgers arrested, the penalties imposed, and whether enforcement differs between Haredim and other sectors.

Last week, the IDF provided partial data on yeshiva students who failed to report to recruitment centers, as revealed by Ynet. However, the military has yet to submit answers on the range of penalties for draft dodgers, the duration of detention for those convicted, and any disparities in enforcement and sentencing between Haredim and non-Haredim. In a previous hearing in June, it was claimed that the IDF lacks segmented data on draft evasion among Haredim compared to other sectors, relying instead on general figures and not distinguishing between evaders and deserters. The partial data provided was also reportedly outdated, reflecting the situation from about a year prior.

Judge Bibi admonished the military representatives for their lack of compliance, noting that deadlines for submitting responses had been set and missed, even after extensions were granted "as a favor." She expressed dismay at the state's perceived disregard for the court, stating, "It seems the state is disrespecting the court more than once." The judge further elaborated on the repeated delays, including a request to cancel a hearing after the deadline had passed and a claim that a response could not be prepared by October 19th because the relevant decision only arrived on the evening of October 13th.

Uri Keidar, CEO of the Israel Free Movement, which, along with the Association for Civil Rights in Israel, requested the information, commented that the judge's remarks highlight the extent of the failures and attempts at concealment by IDF officials seeking to obscure the reality of selective enforcement. He asserted that the era of "deals, bypasses, and attempts to play with numbers" is over and that anyone attempting such tactics will be exposed, calling for equality.
