In a groundbreaking ruling, an Israeli family court annulled a prenuptial agreement signed over a decade ago between a Haredi couple, citing exploitation of the husband's extreme dependence. The couple, married for 28 years with four children, had acquired two apartments partly funded by the husband's family. After 18 years, they signed a prenuptial agreement transferring full ownership of these properties to the wife, leaving the husband without any property rights, bank accounts, or financial security in case of separation.

Following their separation three years ago, the wife sought to enforce the agreement, while the husband filed a counterclaim to invalidate it. Judge Orit Ben-Dor Libal ruled in favor of the husband, represented by attorney Yehoshua Schwartz, stating he met the heavy burden of proof. The court found the husband signed the agreement under severe existential anxiety about divorce, without independent legal advice or fair negotiation.

The judge emphasized the wife knowingly exploited his mental state and misled him by presenting the agreement as a mere protective measure against creditors rather than a binding contract. The court also criticized the earlier approval of the agreement as superficial, failing to consider the husband's total dependence and lack of access to independent finances. This precedent clarifies that Israeli courts will not uphold blatantly unbalanced agreements made under psychological pressure and economic exploitation, particularly within the Haredi community but applicable broadly in family law.
