Australian Court Grants Protection to Israeli Family Refusing Military Service in Gaza
An Israeli family residing in Australia for about a decade has been granted protection by an Australian court after refusing military service in Gaza. The family, consisting of parents and their three children who recently turned 18, initially applied for protection visas following the outbreak of Israel's 'Operation Iron Swords' in October 2023, citing security threats and terrorism risks in Israel. Their initial visa requests were denied by the Australian government, prompting an appeal.
The family argued they moved to Australia in 2016 to secure a safer future for their children, away from terror attacks in Israel. The father recounted personal trauma from witnessing terror attacks in the 1990s and living through missile attacks during the 2014 Gaza conflict, expressing fear for their safety after the October 7, 2023 events. He also stated that staying in Australia would prevent his children from being conscripted into the Israel Defense Forces (IDF).
The court rejected the claim that missile attacks constituted targeted discrimination but accepted the three adult siblings' testimony that they had sworn to refuse IDF service to avoid participating in combat operations in Gaza. The siblings expressed concern about involvement in actions violating international humanitarian law and the risk of imprisonment for up to two years in Israel for refusal.
The court referenced arrest warrants issued by the International Criminal Court against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Galant, alongside UN investigation reports, deeming these credible evidence of unlawful IDF activities in Gaza. It ruled that enforcing compulsory military service and punishing refusal in this context amounted to persecution based on political opinion. Consequently, the court ordered a reassessment of the entire family's protection visa application under the Refugee Convention, obliging Australia to grant them asylum.
This decision highlights the legal recognition of conscientious objection to military service in conflict zones and the international scrutiny of Israeli military operations in Gaza.
