MK Rotman Says Israel's Constitutional Crisis Reflects Deep Regime Identity Struggle

In a detailed interview on the 'Lean Constitution' podcast by Channel 7 and the Jewish People Policy Institute, MK Simcha Rotman, chairman of the Knesset Constitution, Law and Justice Committee, outlined his comprehensive legal and political worldview regarding Israel's ongoing constitutional crisis. Rotman emphasized that the conflict over the judicial system is not a debate about specific laws but a fundamental struggle over the nature of Israel's regime and the balance of power between elected officials and the judiciary.

Rotman criticized the Supreme Court for gradually expanding its authority, transforming from a judicial review body into a central political actor. He warned that this shift undermines democratic sovereignty, which he believes should rest with the public through their elected representatives in the Knesset. While acknowledging the need for judicial oversight in cases of procedural flaws or overreach, Rotman opposes the court overriding legislative decisions on core public policy issues.

Addressing attempts to reach broader consensus on judicial reforms, Rotman recounted his participation in multiple dialogue efforts, including talks at the President's residence. He stated that proposals for compromise were repeatedly rejected because the dispute concerns the legitimacy of changing the power balance, not the wording of reforms. He argued that opposition to reducing the court's power stems from those who view any such change as a threat to the existing order.

Regarding the initiative to codify inter-branch relations through a Basic Law on legislation, Rotman expressed skepticism that even a significant parliamentary majority could prevent judicial intervention. He noted that laws with broad Knesset support have still faced court challenges, indicating the problem lies in the judiciary's perception of its own authority.

Concluding, Rotman framed the judicial system debate as a defining democratic issue for Israel. He stressed that without a clear redefinition of the separation of powers affirming that public decisions are made by elected officials, tensions between the Knesset, government, and judiciary will persist in Israeli politics for years to come.
