Tel Aviv Court Rules on Public Access to Nahal Assi, Upholds Kibbutz Rights

The Tel Aviv District Court issued a significant ruling on Thursday, concluding a long legal dispute over public access to Nahal Assi near Kibbutz Nir David. Judge Idit Berkovich rejected a class-action lawsuit against the kibbutz, affirming that while the public has a right to access this natural resource, a class action is not the appropriate method to resolve the complex conflict. The court emphasized the need to balance public access rights with the kibbutz members' privacy and property interests, noting the kibbutz’s substantial investments of tens of millions of shekels in restoring and maintaining the stream and its surroundings.

The judge described the dispute as a "multi-faceted problem" without a simple legal solution, stating that it is the state's responsibility to establish practical conditions that allow public access while protecting residents’ privacy, safety, and daily life. The court endorsed the state’s "Green Beach" framework from a previous administrative petition, which permits public entry to the stream from its western end outside residential areas and controlled access to the southern bank, but prohibits unrestricted access to the northern bank adjacent to the kibbutz homes.

The ruling clarified that Nahal Assi is a public resource and the kibbutz’s land rights do not grant ownership of the water source or absolute authority to block public access. However, the public’s right does not automatically allow unrestricted entry through the kibbutz’s main gate. The court found that blocking the kibbutz gate does not constitute unlawful discrimination and rejected claims for compensation for the period before access was regulated, partly because the state had not previously established a suitable access plan. The judgment did not resolve whether the kibbutz has the authority to block its gates, leaving that question open for future consideration.
