Tel Aviv Court Rejects Yossi Klein's Defamation Suit Against Yair Netanyahu and Likud

The Tel Aviv-Jaffa Magistrate's Court dismissed a defamation lawsuit filed by journalist Yossi Klein against Yair Netanyahu and the Likud party on Thursday. The suit, seeking nearly 315,000 shekels, stemmed from posts on the social media platform X in February 2023 related to Klein's opinion piece in Haaretz titled "Attention: 1933 Is Already Here," which discussed protests against the Israeli government and potential escalation. Two days after Klein's article, journalist Yair Levi tweeted what appeared to be a quote from Klein's column, which was later shared by Likud along with a police complaint accusing Klein and others of incitement and calls for civil disobedience. Yair Netanyahu also shared Likud's post.

Klein argued that his words were distorted to portray him as encouraging violence. The court agreed that Levi's tweet misrepresented Klein's statements, suggesting regret over the absence of bloodshed. However, the judge ruled that Klein failed to prove that Likud or Yair Netanyahu published the distorted quote. Likud's post included only a portion of Levi's tweet that did not contain the misrepresented quote. The court found Likud's post expressed the party's opinion on Klein's article amid a political debate and did not present the claim that Klein advocated violence as fact, thus not constituting defamation.

The court also rejected the defendants' truth defense, stating that Klein's full article did not promote or encourage violence but merely forecasted a possible protest escalation. Even if the post had been defamatory, the defendants would have had a good faith defense since it was an expression of opinion on a public matter within reasonable bounds. Consequently, the court ordered Klein to pay 15,000 shekels each to Yair Netanyahu and Likud, totaling 30,000 shekels, and dismissed the lawsuit entirely.
