Patient Sues Dentist for Alleged Negligence Causing Total Functional Disability
A patient has filed a lawsuit at the Haifa Magistrate's Court against her dentist, claiming that negligent dental treatment resulted in her complete functional disability. The patient underwent a procedure in 2024 involving the extraction of all her teeth and the installation of implants with bridges. She alleges that from the outset, she experienced severe pain, infections, inability to chew or speak properly, gum bleeding, and changes in speech due to poorly fitting bridges. Despite complaining, the dentist reportedly dismissed her concerns, saying she would "get used to it." Subsequent corrective work, including grinding the bridges, allegedly worsened her condition. She claims the dentist avoided responsibility, leaving her with significant oral damage and ongoing pain.
The patient attached an expert opinion stating she suffered a permanent 40% medical disability due to the dentist's negligence, but she argues her functional disability is effectively 100%. She also cites severe psychological effects, including anxiety and diminished self-esteem. The patient fears the dental work will eventually fail, and she lacks the financial means for further treatment. She is seeking approximately 370,000 shekels in compensation for existing damages and half that amount for restorative treatment costs, plus up to 2.5 million shekels for general and future damages.
The dentist responded that the lawsuit presents a partial and inaccurate account. He said the patient arrived with a complex dental condition and that a treatment plan was professionally designed and approved by her. The treatment was carried out in standard stages, including extractions, implant placement, and temporary and permanent restorations. The clinic claims it accommodated the patient's aesthetic requests with digital scans and additional meetings, and that she approved the final restoration before permanent bonding. The dentist noted the patient had prolonged absences due to personal issues but that the clinic remained flexible and responsive throughout. The clinic asserts all adjustments and communications are documented and will be presented in court, expressing confidence that the full evidence will clarify the facts. They declined further comment out of respect for the ongoing legal process.
