Israeli Court Allows Hamas Terrorist Physical Contact With Mother Despite Prison Rules

The Nazareth District Court has approved a request permitting Hamas terrorist Rami Habiballah to physically embrace and kiss his mother during a visit, overriding Israel Prison Service (IPS) regulations that prohibit physical contact during inmate visits. The decision was made by three judges, Yifat Shtrait, Tamar Nissim Shai, and Usila Abu-Asad, who justified the ruling based on the advanced age of Habiballah's mother and his condition.

Habiballah, an Arab Israeli teacher from northern Israel, was arrested about two years ago by the Shin Bet and police. He faces serious charges including attempting to recruit Arab Israelis for terrorist attacks and providing Hamas operatives with the location of a security facility. According to the indictment, on October 7, he considered traveling south to join Hamas operatives. His detention has been extended pending trial.

The state and IPS strongly opposed the request, citing it contradicts established prison visitation protocols. National Security Minister Itamar Ben-Gvir condemned the court's decision as scandalous, emphasizing that while terrorists endure harsh prison conditions, the court grants them leniency. He pledged reforms in the prison and police systems and indicated judicial changes would follow in his next term.

This ruling highlights tensions between judicial decisions and security protocols concerning Palestinian security detainees in Israel. The case continues to draw public and political scrutiny as the trial proceeds.
