Israel's Supreme Court Reinstates Joint and Unified Lists, Cassif for Elections

Israel's Supreme Court on Friday overturned decisions to disqualify the Joint List, the United Arab List, and Member of Knesset Ofer Cassif from participating in upcoming elections. The court ruled that the grounds for disqualification, which included denying Israel as a Jewish and democratic state or supporting armed struggle against Israel, were not met.

In the case of the Joint List, the judges unanimously found no evidence presented to the Central Elections Committee that met the legal criteria for disqualification. Similarly, the court unanimously decided that the United Arab List should be allowed to run, as the submitted materials did not meet the disqualification standards.

Regarding Ofer Cassif, the Central Elections Committee had initially decided to disqualify him based on allegations of denying Israel's Jewish and democratic character and supporting armed struggle. However, the Supreme Court, in a 7-2 majority decision, allowed Cassif to run. The majority opinion, while condemning Cassif's "outrageous and disgusting statements and actions," concluded they did not meet the "critical mass" of evidence required for disqualification.

Two dissenting judges, however, argued that Cassif's statements and activities directly or indirectly supported armed struggle against Israel, citing past remarks as further evidence. The court had previously advised Sami Abu Shehadeh, head of the National Democratic Assembly Party, to withdraw his candidacy, suggesting his controversial statements might lead to disqualification. Following this, the party announced Abu Shehadeh's withdrawal, citing political responsibility towards the Palestinian people and the potential negative repercussions for political and parliamentary work.

The party stated that Abu Shehadeh fought the legal and political battle until the end, only withdrawing after the court indicated a majority leaned towards upholding his disqualification. The party emphasized that the issue transcended Abu Shehadeh's candidacy, raising serious questions about the limits of political legitimacy for Arab citizens and the use of disqualification to restrict Arab political action.
