Election Committee's Ban on Arab Parties Likely Headed for Supreme Court Review

The Central Elections Committee has disqualified several Arab political parties from participating in the upcoming elections, a move described as significant but not necessarily final. Historically, such disqualifications by the committee, which is composed of party representatives, have often been overturned by the Supreme Court.

This pattern has repeated across multiple election cycles. In 1988, the Supreme Court reversed the committee's ban on the Progressive List for Peace. A heated debate occurred in 2003 when the committee disqualified the Balad party and candidates Ahmad Tibi and Azmi Bishara, but the High Court of Justice reinstated them, citing insufficient evidence for disqualification.

Further instances include 2009, when the committee banned the Ra'am-Ta'al and Balad parties, only for the Supreme Court to overturn the decision. In 2015, both Haneen Zoabi and Baruch Marzel were disqualified by the committee but reinstated by the Supreme Court, which views disqualification as an extreme measure reserved for rare cases.

In 2019, the committee disqualified the Ra'am-Balad list and MK Ofer Cassif, but the Supreme Court allowed them to run. In a rare reversal, the Supreme Court disqualified Michael Ben Ari after the committee had approved him. In 2020, MK Heba Yazbak was disqualified by the committee and later reinstated by a narrow Supreme Court majority. Similarly, in 2021, Avtisam Mara'ana was disqualified and then reinstated by the Supreme Court.

The historical data indicates a tendency for the Elections Committee to disqualify candidates and parties, while the Supreme Court often reinstates them, particularly those from Arab parties, interpreting disqualification rules narrowly.
