Tel Aviv Municipality Reintroduces Building Permit Variances for Specific Projects
The Tel Aviv-Yafo Municipality is reintroducing building permit variances, known as 'easements,' for specific projects, less than two years after the Planning Administration officially canceled them. The new initiative, termed a "program for formalizing easements," will allow for such variances on dozens of plans and projects, even after the general cancellation by the supreme planning institution. These easements, which permit deviations from existing plan regulations during the building permit application phase, were originally intended for unique cases but became widespread, leading to significant delays and "chaos" in permit issuance, according to senior planning officials. In some instances, over 80% of residential permit applications for projects with more than 20 units sought variances.
The easements were definitively abolished in January 2025, following a process that began in January 2023. However, the Tel Aviv local planning committee now seeks to reinstate them within its jurisdiction, albeit in a limited capacity. The new program aims to facilitate better planning in areas undergoing renewal based on older, yet still relevant, plans. The municipality emphasizes that these provisions will not alter the character of the neighborhoods and are intended solely for planning improvements. The variances will apply only to new construction based on a closed list of specific plans, excluding those based on later, more detailed plans.
The program includes a long list of plans across various areas of Tel Aviv-Yafo, such as historical Jaffa (including the Clock Square complex, Tzlalon, Ajami, and the American Colony), Kiryat Shalom, northern Tel Aviv neighborhoods with single-family homes, the city center, and areas like Neve Tzedek, as well as larger district plans. Specific variances include increased building coverage ratios in historical Jaffa up to 85% from the permitted 70%, and up to 75% of roof area for optimal planning, with allowable side and rear protrusions up to 10%. In other areas like Shapira and Kiryat Shalom, building coverage can increase by up to 6% without expanding total building areas. For single-family homes in the north, total building areas can increase by up to 6% of the lot size.
The Planning Administration, while acknowledging the original intent to create certainty and prevent delays, stated that easement requests can sometimes resolve planning blockages or achieve optimal, timely designs. They view Tel Aviv's program as expanding the implementation possibilities of approved plans, differentiating between various areas and physical characteristics. The administration clarified that even in these cases, permits can be processed through authorized agents, subject to existing clarification procedures. This move comes amid recent disagreements between the Planning Administration and the Tel Aviv municipality regarding planning policies.
