For example, saying "Sorry, I was holding my phone for just a second" can be interpreted as an admission of using the device while driving, and "Sorry, I didn't see the sign" can confirm the violation occurred.

Geisler emphasizes that while an apology is not an automatic conviction, its interpretation depends on the context, the specific words used, and the surrounding circumstances. An apology for tone of voice differs from admitting to running a red light. Such statements are evaluated alongside other evidence, not in isolation. Drivers should understand what they are accused of before responding and ensure their statement reflects their knowledge, not a guess aimed at ending the encounter. While honesty is crucial, there's no need to agree with an accusation simply because it's stated confidently.

Drivers sometimes apologize hoping for a warning instead of a ticket. While admitting guilt is a condition for a warning, it doesn't guarantee one, as it's subject to additional conditions and discretion. A confession made solely on the assumption the officer will let them go might result in both a ticket and a statement that could be used against them later.

Following an accident, expressing sorrow is natural, but Geisler advises distinguishing between human empathy and admitting fault. A statement like "I'm really sorry" might be a reaction to a difficult situation, not a calculated admission of responsibility. Conversely, factual descriptions like "I didn't look before I pulled out of the parking spot" can be significant in determining liability. This applies to WhatsApp messages too; even if personal or conciliatory, they can be presented in court.

Ultimately, an apology itself doesn't replace a thorough investigation of the accident details. In cases of bodily injury claims under Israel's compensation law, liability is generally presumed, meaning an apology or even admission of fault may not forfeit the right to compensation. Geisler stresses that caution with words doesn't negate a driver's duties after an accident, such as stopping, assisting the injured, and providing details.
