Israeli Elections Seen as Decisive for Rule of Law Amid Judicial Overhaul Plans

Upcoming Israeli elections are poised to determine the future of the country's legal and governmental systems, according to a prominent legal commentator. While many political parties are focusing on other issues, the core battleground is expected to be the judicial system and the balance of power between the branches of government. This perspective is notably shared by the party of Bezalel Smotrich and Simcha Rothman, who recently unveiled their plan to complete a "judicial overhaul."

This proposed overhaul includes significant changes to the judiciary, such as appointing two-thirds of the Supreme Court justices, selecting a new Attorney General, and potentially altering the composition of the committee that chooses judges. It also aims to redefine the authority of the Supreme Court to disqualify laws and impact the independence of the Bar Association. Smotrich and Rothman have expressed determination to fully implement their agenda.

A recent conference at Tel Aviv University, discussing the book "On the Brink" by legal commentator Moshe Gureli, highlighted the sense of urgency among legal professionals. Former Deputy Attorney General Dina Zilber stated that the upcoming elections are "fateful" for the nation's future, emphasizing the need for fundamental reform in the political culture rather than just specific parties.

Former Attorney General and retired Supreme Court Justice Menachem Mazuz praised current Attorney General Gali Baharav-Miara for her resilience in confronting the government's actions, noting that such intense confrontations between the Attorney General's office and the government are unprecedented. He argued that Baharav-Miara had no choice but to resist the government's explicitly unlawful actions, which he characterized as part of a "judicial coup."

Retired Supreme Court President Esther Hayut also stressed the importance of an independent judiciary for preserving press freedom and the broader democratic discourse. The commentary suggests that amidst the political noise, voters must discern the critical issues at stake in the election, particularly those concerning the country's governance and legal framework.
