Israel Bar Association Bars AI From Independent Legal Advice and Case Management

The National Ethics Committee of the Israel Bar Association has issued updated guidelines prohibiting artificial intelligence (AI) systems from making significant legal decisions, offering independent legal counsel, drafting court documents, or managing legal proceedings without direct human oversight. The committee clarified that AI systems are evolving beyond simple query-response tools and can now include autonomous components capable of planning actions, selecting tools, and interacting with external systems independently.

The guidelines emphasize that increased AI autonomy correlates with heightened ethical, professional, and procedural risks. However, certain technical, limited, documented, and reversible operations performed under human supervision and within clear parameters, in execution of a human-decided action, are permissible. The mere presence of an autonomous component within an AI system does not automatically prohibit its use, but it mandates that lawyers carefully assess its suitability for representation, the nature of permissible operations, and the actual level of human control.

Ultimately, the lawyer remains personally and directly responsible for every professional action, decision, consultation, argument, or work product generated with the assistance of AI systems.
