Justice Ministry Divided Over Disqualifying Arab Party Leader Backing Hamas Attack

Senior officials within Israel's Ministry of Justice are reportedly divided over whether to support the disqualification of Sami Abu Shehadeh, the chairman of the Arab political party Balad, from running in the upcoming Knesset elections. The controversy stems from an article Abu Shehadeh allegedly published in Arabic on October 8, 2023, the day after Hamas's deadly attack on Israel, which reportedly expresses support for armed struggle against Israel.

During meetings held on Wednesday and Thursday, a heated debate ensued regarding the extent to which Abu Shehadeh's statements could be interpreted as clear support for the Hamas attack and armed conflict. Some officials, including Deputy State Attorney Alon Altman, argued that the statements were not sufficiently clear to warrant disqualification. Conversely, Deputy Attorney General Avital Sompolinsky and the director of the High Court petitions department leaned towards supporting his disqualification.

Other senior figures emphasized the importance of freedom of expression, even in the face of statements considered offensive and terrible. The State Attorney, who participated in the meeting via Zoom, reportedly remained silent throughout the discussion.

Ultimately, Attorney General Gali Baharav-Miara concluded the discussion by stating that a decision would be deferred until Abu Shehadeh has had the opportunity to present his explanations and justifications for the article before the Ministry takes a definitive stance.
